BUYING YOUR FREEHOLD. SOME QUESTIONS
Q1. My landlord has served an offer notice under the 1987 Act. I think the price is too high. Do I have to pay this amount?
A1. If the price is too high you can always offer less. Even if the freeholder rejects your offer he can't sell the freehold within 12 months for less than the amount in his notice. Even if he sells to someone else for the high price, your right under the 1993 Act to call for the freehold can be exercised against the new freeholder. This makes it unlikely that anyone else will pay more than it is worth.
